1.    Terms & Conditions Overview

Insight GPS (ABN: 45 098 953 445) is committed to providing quality services to you and this policy outlines our responsibilities as the provider of GPS tracking products & services as well as your responsibilities to us as the user of the GPS tracking products & services.

  1. By using this service, you agree to be bound by the terms of this agreement.
  2. This agreement begins on the date on which you either
    1. Create an account on our Locate ‘web portal’ (https://locate.insightgps.com.au) and proceed to access the service or
    2. Purchase hardware from our website (www.insightgps.com.au), or through a listing on a third-party website that we control (for example, our eBay account).

2.    Subscription

A subscription is required to use the hardware provided by Insight GPS.

For reference, the ‘subscription’ includes pre-installed SIM card, mobile network access, access to our web portal, associated mobile applications & our notifications service (SMS, E-Mail & Web).

For your peace of mind, our servers are based within Australia. We aim to keep at least 365 days tracking data, which is accessible to you online 24/7 through your own individual login to our web portal.

Your chosen subscription period will be invoiced approx 7 days prior to your current subscription (or trial) period finishing. The cost of renewal is subject to change, but we will alert you ahead of time if this is to occur.

Failure to pay your subscription renewal on time may result in us suspending access to your web portal login.

  1. If payment is made within 30 days of the due date, your account will be un-suspended, and billing will continue as per the original schedule. Data collected during the suspension period will be retained within your web portal account.
  2. If payment becomes more then 30 days overdue, we reserve the right to permanently de-activate your web portal account. This will result in data loss. You will have the option to take out a new subscription at current pricing using your current hardware.

Additional information on subscriptions:

  1. Your chosen subscription period can be changed by contacting support. Subscription options may change in the future, please see our website or contact support for current offerings.
  2. If you wish to cancel your subscription you will need to contact support. We are unable to refund subscription periods that have been paid ahead, but we can cancel your subscription at the end of your current billing period.
  3. If you wish to create a new subscription sometime in the future using the same hardware, please contact support. Our team will be able to advise if this is possible (based on SIM card activation status & hardware compatibility).
  4. Finally, if you need to replace your tracking hardware for any reason (e.g., theft, written-off vehicle [tracker not recovered] etc) please contact support so that we can link replacement hardware to your current paid subscription.

There are several important points that we must cover regarding the subscriptions.

  1. The Limited Warranty does not apply to the subscription component of our product offering.
  2. Hardware placement/installation, mobile network coverage (including blackspots), current location, network congestion, server load, the possibility of DDoS & other cyber-attacks, and other related factors can impact your overall experience with the subscription. While we do everything reasonably possible to prevent any issues from impacting your experience, we provide no guarantees in performance or accessibility with respect to this component of our services.
  3. The subscription will only work with devices that we sell through our website (www.insightgps.com.au), or through a listing on a third-party website that we control (for example, our eBay account). It is not compatible with third-party devices.
  4. When combined with compatible hardware, our subscription is a handy tool for monitoring the current real-time location of your assets, which in turn can assist with theft-recovery. However due to the nature of how various external & internal networks operate, Insight GPS does not guarantee the protection or security of assets that contains its hardware. Additionally, we cannot be held responsible for losses caused by software/hardware error, notifications, mapping inaccuracies and incorrect tracking data. In no event will Insight GPS be liable for theft, damage, loss of anticipated savings, loss of profit, loss of data, loss of use of the product or any associated equipment, or incidental, indirect or consequential losses or damages of any nature whatsoever, to the fullest extent that those losses or damages can be disclaimed by law.

3.    Returns

We only accept returns that have been allocated an RMA number. Items returned without an RMA number attached won’t be accepted or will be sent back to the sender at their cost.

4.    Limited Warranty

A 12-month “Limited Warranty” will apply to all hardware purchased through from our website (www.insightgps.com.au), or through an official listing on a third-party website that we control (for example; our eBay account).

Insight GPS (as the manufacturer of the hardware) warrants that the product is at the time of its original purchase free of defects in materials and workmanship (“Limited Warranty”). Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. The benefits of this warranty are in addition to other rights and remedies of the consumer under a law in relation to the goods or services to which the warranty relates.

The Limited Warranty is subject to the following terms:

  1. The subscription is excluded from the Limited Warranty.
  2. The Limited Warranty is only valid in the country of sale (Australia).
  3. Repair or replacement may involve use of fully functional reconditioned hardware / brand new hardware (at our discretion). The returned hardware will become our property upon receiving it back into our possession.
  4. If Insight GPS repairs or replaces the hardware, the replacement item will be warranted until the end of the original Limited Warranty period or for 6 months (whichever is longer).
  5. The Limited Warranty will not apply if the defect was caused through any of the following:
    1. Removal of the following: SIM card, warranty seal, identification numbers, water indicators or
    2. Evidence of opening or tampering with the hardware or
    3. Normal wear & tear or
    4. Use that directly contravenes the installation instructions and/or operating instructions, rough handling, exposure to moisture or dust beyond what the item of hardware is rated for, corrosion, unauthorised modifications, unauthorised repair, accidents, forces of nature, physical damage, evidence of short circuit or
    5. Use of an accessory that isn’t authorised or designed to be used with the hardware or
    6. Anything else that’s not within reasonable control of Insight GPS.
  6. If you believe that your hardware has a fault which is not excluded under (point 4 of ‘Hardware Warranty’) the process of claiming under the Limited Warranty is as follows:
    1. Consult all available user guides (including any FAQ guides online) to determine if the issue can be resolved.
    2. Contact support through any of the available contact methods at our website (www.insightgps.com.au) with at minimum the following details (name, email address, postal address, tracker ID number/s & description of the problem).
    3. Our team will assess the fault and perform steps to remotely diagnose the problem. In some cases, we may require photographs of the product/installation to be sent to us before we can proceed any further.
    4. If we believe that there is indeed a fault with the hardware that cannot be fixed remotely, we will send you details on where to send the hardware so that it can be assessed and assign an RMA number so that it can be identified on its return. Hardware will be assessed as soon as reasonably possible once received and the outcome provided to you in a timely manner.
    5. If we determine that the hardware requires replacement, we will ship it to you as soon as reasonably possible. Your subscription will be ‘paused’ from the time that your hardware was out of action to receipt of your replacement hardware, so long as this time period is reasonable.
    6. If we determine that the hardware is faulty but is deemed to be excluded from the Limited Warranty under (point 4 of ‘Hardware Warranty’), we will offer to return the hardware to you at your expense.  Your subscription will not be ‘paused’ in the case that your hardware has been excluded from warranty coverage.

In no event will Insight GPS be liable under these Terms & Conditions for loss of profit, loss of anticipated savings, loss of data, loss of use of the product or any associated equipment, or indirect, incidental or consequential losses or damages of any nature whatsoever to the fullest extent that those losses or damages can be disclaimed by law. In any case Insight GPS and its direct & in-direct suppliers’ entire liability under any provision of this Limited Warranty will be limited to the amount actually paid by the customer for the hardware components. Insight GPS does not exclude any liability for personal injury or death arising from its own negligence.
